Terms and conditions

1. Who we are

2. Scope

These terms apply to every order placed through hetvatje.nl. Deviations only apply if we have agreed them with you in writing (e-mail included).

3. What we offer

We sell used, empty whisky casks. Every cask is unique. Photos, dimensions, condition and known defects are shown on the product page and form part of the offer. Signs of use that come with a used cask (discolouration, scratches, slight leaking when dry) are not defects. Obvious mistakes in the offer do not bind us.

4. The contract

The purchase is concluded once you have paid for the order and we have confirmed it by e-mail. If you do not pay online when ordering, we hold the cask for you and the purchase is concluded once payment has been received. A reservation that remains unpaid lapses.

5. Prices and payment

All prices are in euros and include 21% Dutch VAT. Delivery costs are shown separately before you order. If we have no fixed delivery price for your address, your order is a request: we reserve the barrel, ask the carrier for a price and send you the total. The purchase is only concluded when you accept that total by paying; until then you can let the request lapse free of charge. You pay by iDEAL (via Mollie) or, if agreed with you, by bank transfer.

6. Delivery and pickup

We deliver within the Netherlands only, usually within 5 to 10 working days after payment, at a time agreed with you. Pickup is possible at the chosen pickup moment in De Meern. The risk of loss or damage passes to you once the cask has been handed over to you (or a person you designated).

7. Right of withdrawal

You may withdraw from the purchase within 14 days of receiving the cask without giving a reason. How this works and what returning costs is explained on Withdrawal and returns. You can withdraw using the Withdraw from contract button at the bottom of every page.

8. Conformity and guarantee

You have the statutory rights in case of a defect: the cask must have the properties you could expect from its description. A defect shown on the product page before the purchase does not count as non-conformity. Report a defect as soon as possible after discovering it, preferably with photos.

9. Complaints

Please e-mail complaints to contact@hetvatje.nl. We acknowledge receipt and reply in substance within 14 days. If we cannot resolve it together, you may bring the dispute before the competent court.

10. Applicable law

Dutch law applies to these terms and to every contract with us. This does not affect the mandatory rights you have as a consumer in the country where you live.
